Question: What Should You Do If You Were Treated Unfairly By SSD Administrative Law Judge?

Answer:

But, if you feel any ALJ treated you unfairly, then report it to the SSA and ask them to look into the matter.  Even though you do not plan to file a Social Security Disability appeal.  Then you should have, your attorney or representative who is authorized to act on your behalf at the SSD hearing can file a complaint.  At this point, SSA must receive the complaint within 180 days. Either the date of the incident or the date you were aware of the bad behavior.  You can ask SSA to look into the unfair treatment complaint while they are making a decision on your claim for benefits.

Question: Where to Mail or Fax My Complaint Request?

Answer:  To File a Complaint about Unfair Treatment by an Administrative Law Judge (ALJ).  Mail your complaint to the Office of Disability Adjudication and Review Division of Quality Service, 5107 Leesburg Pike, Suites 1702/1703 Falls Church Virginia 22041-3255 or fax it to 703-605-8501.

Information to include in complaint letter or fill out a complaint form for allegations of program discrimination or unfair treatment by the Social Security Administration.  Click on this link https://www.ssa.gov/forms/ssa-437.pdf to get form SSA-437-BK (09-2013) EF (09-2013)

Give the Social Security Administration (SSA) your complaint in writing.  If you are unable to write a complaint letter, then SSA will write it for you.  Please give SSA as many details of in the incident as you can, including:

  • Name, address, and telephone number;
  • Social Security number;
  • Name of the person who treated you unfairly;
  • Describe in detail how you were unfairly treated;
  • What actions or word you thought were unfair;
  • Was there any witness saw or heard the unfair treatment; and
  • If someone is writing the unfair treatment complaint about you. Then give SSA your relationship to that person.  Include your and their name, address, and telephone number.

Question: Is there easy to get approved for Social Security Disability Benefits?

Question: For a long time I got my social security on the 4th Wednesday of the month and now it has changed to the 3rd of every month. Why did it change?

Answer: If your birthday was on July 4, 2017, which was a holiday, then you will receive your check on July 3, 2017.  Here are the benefits paid date based on your Birthdate.

Question: I got part of my back payment that was due to my son, it’s been over 8 months when would he be getting the past due amount??

Answer:  Carmel calls the Social Security Processing Center Telephone Contact Information.  Click on this click https://www.ssa.gov/representation/pct_contact_info_under54.htm the use the first 4 digits of your son’s Social Security Number to find the correct phone number to call.  Carmel asks them what date your son will get the remainder of his disability back pay.

Question:  I received a debit express card in the mail about a month ago does that mean approved .still no funds on the card

Answer:  Heather, did you receive a Social Security Disability or Supplemental Security Income approval award letter?  If you did not receive a Social Security Disability or Supplemental Security Income approval award letter then it is a great possibility you have no funds on your debit express card.  The Social Security Administration mail the cards out so when you do get approved your funds will go on that card.  If you have a bank account then you should let know too.

Question:  Can I apply for Supplemental Security Income (SSI) Benefits online?

Answer:  No.  There are two ways you can apply for Supplemental Security Income Benefits.  You can apply for SSI benefits by calling the Social Security Administration’s customer service at 1-800-772-1213 or TTY 1-800-325-0778 you are hard of hearing or deaf.  Also, you can make an appointment at your local Social Security Office to apply for SSI Benefits.

Answer: Yes you can if enough new medical evidence is submitted and a letter requesting to get your Social Security Disability Appeal Case reviewed. In the book, it shows you what medical documents and tests you may need to prove you are indeed disabled and can no longer able to work.

Question: Can your spouse’s income affect SSI (Supplemental Security Income)?

Answer: Your husband or wife’s income only matters for SSI (the low income, need-based disability program), since the SSI program (for those who paid FICA taxes over many years) has no income limits. If you are married and your husband or wife makes an income, the SSI program might “deem” part of your spouse’s income to be available to you. If your spouse has a sizeable income, his or her income, if deemed to you, can lower your SSI payment or even make you ineligible for SSI.

*************************************************Question: Am I eligible for Social Security Disability Insurance benefits (SSDI)?

Answer: Eligibility for SSDI benefits is based upon a formula of earned credits and your age at the time of onset of disability. You earn social security credits when you work in a job in which you pay social security taxes. Credits are based on your earnings in each quarter of a calendar year. For example, in 2003, for each quarter of the year that you earn $890.00, you receive one (1) credit, up to a maximum of four (4) credits.

Question: Will the Income of a Spouse Affect My SSD (Social Security Disability)?

Answer: Social Security disability, on the other hand, is not a need-based disability program. Therefore, income or resources (i.e. assets) do not affect disability benefits. If your spouse has income it will not affect your Social Security disability amount, whereas if you receive SSI and your spouse has income, that spousal income may very well affect your SSI.
