Immigrants, refugees, asylees permanent resident, and other qualified aliens perhaps can be eligible for SSI Disability under certain, regulations and conditions.

Supplemental Security Income Disability Benefits are for all qualifying U.S. citizens; however none resident’s citizens are sometimes allowed eligible for benefits. This includes nations, aliens, and people who are non-citizens. Usually, a general rule is a qualified immigrant who is perhaps getting deportation or removed from the U.S. is not eligible for disability.

Immigration applicant must prove they are disabled and meets income and asset tests required for SSI Disability. If your sponsor’s income and assets will determine your SSI Disability eligibility.

Qualification for Aliens

The definition of qualified alien is when they are eligible for SSI Benefits. The Department of Homeland Security describes a qualified alien as follows below.

  • If you are lawfully admitted, permanent resident. Which means Amerasian Immigrants.
  • A person leally entered the United States on or before April 1, 1980, please see Section 203(a)(7) for the Immigration and Nationality Act (INA).
  • If a person is paroled in the United States. for one year pursuant to Section 212(d)(5) of the Immigration and Nationality Act.
  • Refugee admitted to the United States under Section 207 of the Immigration and Nationality Act.
  • Section 208 of the Immigration and Nationality Act a person is given asylum.
  • If you are deported or removed is being stayed under Sections 243(h) (before April 1, 1997) or 241(b)(3).
  • Cuban or Haitian of the Refugee Education Assistant Act of 1980 by Section 501(e) will be treated for SSI purposes.

Often times you can become deemed qualified alien, if you or your child, suffered from domestic violence or extreme cruelty by the hands of a relative while a person is in the United States.

Additional Eligibility Conditions

For example, if you are an eligible immigrant then you meet the disability requirements and must prove you are disabled for your SSI Benefits.

  • If you are a permanent resident and have 40 qualifying quarters of work history.
